1. Purpose

These Terms & Conditions of Sale (T&Cs) govern all maritime excursion bookings made with SAILINITY, a company based in Raiatea, French Polynesia.
Any booking implies full and unconditional acceptance of these T&Cs.


2. Booking & Payment

  • Bookings may be made by email, WhatsApp, phone, or through the website.
  • A booking is confirmed only after full payment has been received.
  • Payment methods: secure link (Stripe, SumUp, PayPal) or bank transfer.
  • If payment is not made within the required timeframe, Sailinity may cancel the reservation.
  • Prices listed are inclusive of all taxes.

3. Prices

  • Prices are expressed in CFP francs (XPF).
  • They include sailing, drinks, snacks, and the equipment specified for each excursion.
  • Not included unless otherwise stated: meals, transfers, personal expenses.
  • Sailinity may adjust its prices, but any excursion already paid for will not be affected.

4. Cancellation Policy

4.1 Cancellation by the Client

4.2 Cancellation by Sailinity

Sailinity may cancel or reschedule an excursion in the event of:

  • adverse weather conditions,
  • technical issues,
  • safety-related reasons.

The client may then choose to:

  • reschedule the excursion,
    or
  • receive a full refund.

Short tropical showers or cloudy weather do not constitute valid grounds for cancellation.
Only conditions that threaten safety (strong winds, swell, storms) may result in postponement or cancellation.

👉 The final decision belongs exclusively to the skipper or the manager.


5. Boarding Conditions

  • The maximum number of passengers is limited to 10 based on the navigation permit and cannot be exceeded.
  • The skipper may modify the itinerary or activity order for safety or weather-related reasons.
  • Arrival required 15 minutes before boarding.
  • Significant delays may result in departure without refund. Delays caused by external transfers (taxis, pensions, hotels…) are the client’s responsibility and do not entitle them to a refund.
  • Boarding will be refused in cases of intoxication, drug use, or dangerous behavior.
  • Minors must be accompanied by a responsible adult.

6. Practical Information Onboard

Non-habitable catamaran; sailing is the primary mode of navigation (engine may be used when needed for safety or maneuvering).

  • Limited shade: bring a hat, sunglasses, and sunscreen.
  • No restroom onboard.
  • Bring towels, swimwear, and snorkeling gear if desired.
  • Basic equipment is available onboard.

Although the excursion is mainly conducted under sail, the engine may be used when necessary for safety, maneuvering, or efficiency in low-wind conditions. This does not constitute grounds for complaint or refund.


7. Liability Waiver & Acceptance of Risks

By validating a booking (payment or written confirmation), the client acknowledges and accepts the following:

7.1 Nature of the Activity

The client voluntarily participates in a maritime excursion that may involve:

  • sailing,
  • moving on deck,
  • boarding/disembarking via ladder or dinghy,
  • swimming or lagoon activities.

They acknowledge that the marine environment involves inherent risks.


7.2 Client Obligations

The client agrees to:

  • follow the skipper’s instructions,
  • behave responsibly,
  • report any relevant health issues,
  • not be under the influence of alcohol or substances,
  • properly use the equipment provided.

7.3 Limitation of Liability

Sailinity cannot be held liable for:

  • loss, theft, or damage to personal belongings,
  • injuries resulting from failure to follow instructions,
  • incidents related to undeclared health conditions.

Sailinity operates under NUC commercial status and is fully insured in compliance with Polynesian maritime regulations.


7.4 Express Acceptance of Risks

The client acknowledges and accepts the potential risks associated with nautical activities: slipping, impacts, immersion, cuts, marine wildlife, etc.


7.5 Photo/Video Authorization

Unless the client provides written refusal before departure, Sailinity is authorized to use photos/videos taken during the excursion for communication purposes (website, social media).
No name or personal information will be published without explicit consent.


8. Governing Law & Disputes

These T&Cs are governed by Polynesian law.
An amicable resolution will be sought before any legal action.


9. Contractual Acceptance

Payment for an excursion constitutes full acceptance of these T&Cs, including the liability waiver.


10. International Payments & Banking Disputes

  • For foreign card payments, Sailinity may provide proof of service delivery (passenger list, photos, reports).
  • Any unfounded payment dispute (“chargeback”) after actual participation may result in a recovery procedure.

Client Acknowledgements

☐ I have read and accepted the Liability Waiver and the Terms & Conditions of Sale of SAILINITY.

☐ I expressly authorize SAILINITY SARL to charge my credit card for the full amount of the booked service and acknowledge that this transaction corresponds to a service duly accepted.

☐ I understand that any unjustified chargeback may result in a formal dispute and, if necessary, debt recovery action.
